Business and regulation update in the Netherlands  

Dear JCC member,

We would like to invite you to join the JCC /JETRO/KPMG Seminar on Friday, June 28, 2024.

We have been seeing rapid and extensive business environmental changes in every area. We think some of them were unexpected a few years ago, but the impact on business could be significant. In this unstable situation, we believe that we should focus on how respond in a resiliently manner rather than focus on achieving a stable situation. It is also critical to build up an effective internal environment that is updated in a timely fashion, assess the impact of changes on your business, consider how to respond to risks and opportunities identified. Through this seminar, we will not focus on one topic but will be touching on several topics to which attention needs to be paid by companies operating in Europe. We hope this seminar could be a trigger for an internal discussion in your companies toward even better resilient operations.

Firstly, KPMG will provide an overview of the cyber security environment including related regulations. KPMG will explain the EU’s new Network and Information Security Directive (NIS2) which includes requirements of governance, risk management and reporting for incidents in certain sectors and entities. This will be in effect as per October 2024. Moreover, KPMG will cover the Digital Operational Resilience Act (DORA), an EU regulation which refers to ICT risks and sets rules on ICT risk-management, incident reporting, operational resilience testing and ICT third-party risk monitoring.

Next, KPMG will discuss the landscape of geopolitical risks and responses to be paid attention to in terms of supply and value chain management. KPMG will provide general ideas about initiatives and challenges to respond to these risks to maintain a resilient supply and value chain.

KPMG will, furthermore, provide a regulations update related to sustainability. KPMG will explain the Corporate Sustainability Due Diligence Directive(CSDDD) which requires companies to conduct human rights and environmental due diligence throughout their own operations, their subsidiaries and throughout their business partners’ chains of activities. CSDDD is expected to be implemented in coming few years.

As a closing topic, KPMG will describe the details of the recently published agenda for tax policy and implementation as well as the plans published by the parties in discussion to set up a new government. This is guiding for the tax plans to be announced at Prinsjesdag – Budget Day – on the 3rd Tuesday of September and provides for an early update on anticipated legislation.
